Frome Allotment Association (FAA) Rules

- As of 1 April 2007, FAA plots are only available to residents of Frome town. Addresses will be verified and, as from 20th October 2021, each household may hold only one plot at a time.
- The Tenant shall pay the rent for their plot when it is due.
- The Tenant shall keep the allotment tidy, free from weeds and well cultivated with a predominance of fruit and vegetables. The tenant must also tend to and trim the edges of their plot and the paths surrounding it.
- The Tenant shall not cause nuisance or annoyance to other plot holders or obstruct any communal path.
- The Tenant shall not sublet or give away any part of their plot without written consent from FAA.
- The Tenant shall not cut or prune any communal trees, or take, sell or carry away any minerals, soil, gravel, sand or clay from the allotment.
- The Tenant shall not erect any building on their plot other than sheds and greenhouses. These should not exceed 6’ x 8’. A shed and a greenhouse (or polytunnel) is allowed on the same plot, but neither should exceed 6’ x 8’ and they should be used for storage and cultivation only, and not for the housing of chickens or rabbits.
- The Tenant shall not use barbed wire anywhere on the allotment.
- The Tenant shall carry out anything the FAA deems necessary to prevent the plot from deteriorating.
- The Tenant must take proper precautions when using sprays or fertilisers, minimise any adverse effects on the environment, and comply with current regulations. The herbicide Glyphosate must not in any way be used.
- The Tenant shall not store petrol or fuel oil on site and shall not use or store LPG on site.
- The burning of rubbish and waste is not allowed anywhere on the allotments. Tenants should compost as much of their green waste as possible and dispose of anything else off site.
- No trees should be planted other than fruit trees. These must be dwarf rootstock (M27 or M9) or espaliered, must not grow to more than 8ft in height, and must not overhang adjacent plots or paths.
- No bees should be kept on site.
- FAA is entitled to inspect the plot at any time.
- Frome Town Council, as owner of the site, is entitled to inspect the plot at any time.
- All plot holders are responsible for their own health and safety while onsite.
- As per the FAA Data Protection Statement, you agree to keep your contact details updated so that you can be kept in touch with FAA business.
- When you end your tenancy (whether at your own request, or that of FAA) you must remove any rubbish on your plot and also remove any buildings which you have erected, unless agreed in writing by the site representative.
- By paying your rent for the year, you agree to abide by the current rules.
- These rules shall be used in the place of a formal tenancy agreement.
- FAA has the right to update these rules by agreement of the committee and the elected members. Any updates will be posted on the website and site notice boards (where relevant) and shared with plot holders by the Site Representatives.
REPOSSESSION
The Tenancy shall continue until:
(i) Either party gives the other 12 months’ notice in writing to arrive on or before 6th April or after 29th September in any year.
(ii) By repossession by Frome Town Council after it has given 3-12 months’ notice in writing to the Association because the plot is needed:
(a) for any purpose for which it has been appropriated under any statutory provision.
(b) for building, mining or any other industrial purpose, or for roads or sewers necessary in connection with these purposes.
(iii) By repossession by the Association at any time, giving 30 days’ notice:
(a) if rent or any part thereof is in arrears for 40 days or more, whether legally demanded or not.
(b) if there appears to FAA to have been any breach of these rules by or on behalf of the Tenant.
(iv) By the Tenant moving out of Frome (see 1, above).
